1. Acceptance of Terms
By accessing or using LimeStack ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
LimeStack provides inventory and listing management tools designed specifically for eBay sellers. Our Service helps you organize, manage, and optimize your eBay business through features including inventory tracking, listing management, analytics, and automation tools. The Service is provided as a software-as-a-service (SaaS) platform accessible through your web browser.
3. Account Registration
To use LimeStack, you must create an account and provide accurate, complete, and current information. You are responsible for:
- Maintaining the security of your account credentials and password
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
You must be at least 18 years of age to use LimeStack. By creating an account, you represent and warrant that you meet this age requirement.
4. Acceptable Use
You agree to use LimeStack only for lawful purposes and in accordance with these Terms. You agree not to:
- Misuse the Service or use it in any way that could damage, disable, or impair the Service
- Attempt to gain unauthorized access to any portion of the Service, other accounts, or any systems or networks connected to the Service
- Interfere with or disrupt other users' use and enjoyment of the Service
- Use the Service in any manner that violates eBay's Terms of Service or policies
- Engage in any activity that is fraudulent, false, misleading, or violates any applicable laws or regulations
5. Intellectual Property
LimeStack and its original content, features, and functionality are owned by LimeStack and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. The LimeStack name, logo, and all related trademarks, service marks, and trade names are the property of LimeStack.
You retain all ownership rights to your data, inventory information, and content that you submit to the Service. By using the Service, you grant LimeStack a limited license to use, store, and process your data solely for the purpose of providing the Service to you.
6. Payment Terms
LimeStack operates on a subscription-based billing model. By subscribing to a paid plan, you agree to the following:
- Subscriptions automatically renew at the end of each billing period unless canceled
- You authorize us to charge your payment method on file for the renewal amount
- Subscription fees are non-refundable except at LimeStack's sole discretion
- You may cancel your subscription at any time through your account settings
- Cancellations take effect at the end of the current billing period
- Refund requests will be evaluated on a case-by-case basis at LimeStack's discretion
7. Termination
We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to violation of these Terms. You may cancel your account at any time through your account settings or by contacting us.
Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
8. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. LIMESTACK DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- Any warranty that the Service will be uninterrupted, timely, secure, or error-free
- Any warranty regarding the accuracy, reliability, or completeness of content or data
LimeStack is not responsible for changes to the eBay platform, eBay's APIs, or eBay's terms of service that may affect the functionality of our Service. We will make reasonable efforts to adapt to platform changes but cannot guarantee uninterrupted compatibility.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIMESTACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
In no event shall LimeStack's total liability to you for all damages, losses, and causes of action exceed the amount you have paid to LimeStack in the twelve (12) months preceding the event giving rise to liability.
10. Indemnification
You agree to defend, indemnify, and hold harmless LimeStack and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of another party.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the federal or state courts located in the United States.
12. Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will notify you by email or through a prominent notice on the Service prior to the changes taking effect. Your continued use of the Service after any changes to these Terms constitutes acceptance of those changes.
